(৩) মূল্য পরিশোধর পদ্ধতি:

F10 Departmental Store থেকে ক্রয়কৃত পণ্যের মূল্য কয়েকটি মাধ্যমে পরিশোধ করতে পারবেন। (ক) ক্যাশ অন ডেলিভারির ক্ষেত্রে পণ্য পেয়ে মূল্য পরিশোধ করুন; (খ) +৮৮০১৩১৭৬২২৯৪৫ (মার্চেন্ট) বিকাশ ও নগদ মাধ্যমেও পরিশোধ করতে পারবেন; (গ) তৃতীয় পক্ষ অনলাইন মাধ্যমেও আপনি বিকাশ, নগদ, মূল্য পরিশোধ করতে পারবেন। আরও বিস্তারিত জানার জন্য অনুগ্রহ করে আমাদের রিটার্নএবংরিফান্ডনীতি পর্যালোচনা করুন।

(৪) ডেলিভারির সময়ঃ

টাঙ্গাইল পৌরসভার আকুর টাকুর পাড়া, রেজিস্ট্রি পাড়ায় আমরা ১- ২ (এক থেকে দিন) কার্যদিবসের মধ্যেও ডেলিভারি করে থাকি (যদিও আমরা অল্প সময়ের মধ্যে পন্য দিয়ে থাকি)। এই ক্ষেত্রে ব্যবহারকারীকে সঠিক নির্দেশনা সহ সঠিক ডেলিভারি লোকেশন দিতে হবে।

(ক) টাঙ্গাইল পৌরসভার আকুর টাকুর পাড়া, রেজিস্ট্রি পাড়ায় ৩ কার্যদিবস পর্যন্ত লাগতে পারে।
(খ) পুরো পেমেন্ট পাওয়ার পর দিন গণনা শুরু হবে।
(গ) ক্যাশ অন ডেলিভারির ক্ষেত্রে ডেলিভারি ম্যানের নিকট থেকে পণ্য দেখে নিতে পারবেন। তবে কোন ক্রমেই পণ্য আনবক্সিং করা যাবে না।
(ঘ) ওয়েবসাইটে প্রদশির্ত পণ্যের মোড়ক ও আপনার নিকট প্রেরিত পণ্যের মোড়ক মিল আছে কিনা দেখে নিতে পারবেন। যদি মিল না থাকে অবিলম্বে +৮৮০১৩১৭৬২২৯৪৫, নাম্বারে ফোন করে কমপ্লেইন রেজিস্টার করতে হবে।
(ঙ) ওয়েবসাইটে অর্ডার কনফার্মেশন করার পরেও পণ্যটি না নিতে চাইলে উল্লেখিত ডেলিভারি চার্জ প্রদান করতে হবে

(৫) ব্যবহারের শর্তাবলী

(ঞ) ওয়্যারেন্টি অস্বীকৃতি; দায়বদ্ধতা সীমাবদ্ধতা আমরা গ্যারান্টি দিই না, প্রতিনিধিত্ব করি বা ওয়ারেন্টি দিই না যে আমাদের পরিষেবার আপনার ব্যবহার নিরবচ্ছিন্ন, সময়োপযোগী, নিরাপদ বা ত্রুটি-মুক্ত হবে। আমরা নিশ্চিত করি না যে পরিষেবার ব্যবহার থেকে প্রাপ্ত ফলাফলগুলি সঠিক বা নির্ভরযোগ্য হবে। আপনি সম্মত হন যে সময়ে সময়ে আমরা আপনাকে নোটিশ ছাড়াই অনির্দিষ্ট সময়ের জন্য পরিষেবাটি সরিয়ে ফেলতে পারি বা যেকোনো সময় পরিষেবা বাতিল করতে পারি। আপনি স্পষ্টভাবে সম্মত হন যে আপনার ব্যবহার, বা ব্যবহারে অক্ষমতা, পরিষেবাটি আপনার একমাত্র ঝুঁকিতে রয়েছে। পরিষেবা এবং পরিষেবার মাধ্যমে আপনাকে সরবরাহ করা সমস্ত পণ্য এবং পরিষেবাগুলি (আমাদের দ্বারা স্পষ্টভাবে বলা ব্যতীত) আপনার ব্যবহারের জন্য ‘যেমন আছে’ এবং ‘যেমন উপলব্ধ’, কোনো উপস্থাপনা, ওয়ারেন্টি বা কোনো ধরনের শর্ত ছাড়াই, প্রকাশ বা উহ্য, সমস্ত অন্তর্নিহিত ওয়ারেন্টি বা ব্যবসায়িকতার শর্তাবলী, ব্যবসায়িক গুণমান, একটি নির্দিষ্ট উদ্দেশ্যে উপযুক্ততা, স্থায়িত্ব, স্থায়িত্ব, শিরোনাম-অনটন সহ। কোনো অবস্থাতেই এপকম ই-শপ বাংলাদেশ, আমাদের পরিচালক, কর্মকর্তা, কর্মচারী, সহযোগী, এজেন্ট, ঠিকাদার, ইন্টার্ন, সরবরাহকারী, পরিষেবা প্রদানকারী বা লাইসেন্সদাতারা কোনো আঘাত, ক্ষতি, দাবি বা কোনো প্রত্যক্ষ, পরোক্ষ, আনুষঙ্গিক, শাস্তিমূলক, বিশেষ বা ফলস্বরূপ কোনো ধরনের ক্ষতির জন্য দায়ী থাকবেন না, যার মধ্যে কোনো সীমাবদ্ধতা ছাড়াই লাভ হারানো, রাজস্ব হারানো, ডেটা হারানো, ডেটা হারানো, হারানো খরচ, অনুরূপ খরচ বা ক্ষতির প্রতিস্থাপন। চুক্তিতে, অত্যাচার (অবহেলা সহ), কঠোর দায় বা অন্যথায়, আপনার যেকোনও পরিষেবা বা পরিষেবা ব্যবহার করে সংগৃহীত কোনও পণ্যের ব্যবহার থেকে উদ্ভূত, বা পরিষেবা বা কোনও পণ্যের আপনার ব্যবহারের সাথে সম্পর্কিত কোনও অন্য কোনও দাবির জন্য, যে কোনও বিষয়বস্তুতে কোনও ত্রুটি বা বাদ পড়া সহ, তবে সীমাবদ্ধ নয়, বা কোনও ক্ষতি বা ক্ষতি, পরিষেবার অন্য কোনও সামগ্রী হিসাবে ব্যবহার করা বা অন্য কোনও পণ্যের ট্রান্সমিট বা পোস্ট হিসাবে ব্যবহার করা হয়েছে। পরিষেবার মাধ্যমে, এমনকি যদি তাদের সম্ভাবনার পরামর্শ দেওয়া হয়। যেহেতু এখতিয়ারগুলি আনুষঙ্গিক বা আনুষঙ্গিক ক্ষতির জন্য বর্জন বা দায়বদ্ধতার সীমাবদ্ধতার অনুমতি দেয় না, এই ধরনের এখতিয়ারে, আমাদের দায় আইন দ্বারা অনুমোদিত সর্বাধিক পরিমাণে সীমাবদ্ধ থাকবে৷ আপনি স্বীকার করেন এবং অঙ্গীকার করেন যে আপনি সাইটের পরিষেবাগুলি অ্যাক্সেস করছেন এবং আপনার নিজের ঝুঁকিতে লেনদেন করছেন এবং সাইটের মাধ্যমে কোনও লেনদেনে প্রবেশ করার আগে আপনার সর্বোত্তম এবং বিচক্ষণ রায় ব্যবহার করছেন। আমরা বিক্রেতাদের কোনো ক্রিয়া বা নিষ্ক্রিয়তা বা পণ্যের বিক্রেতা বা প্রস্তুতকারকদের দ্বারা শর্ত, উপস্থাপনা বা ওয়ারেন্টি লঙ্ঘনের জন্য বা এতদ্বারা স্পষ্টভাবে অস্বীকার এবং সেই বিষয়ে সমস্ত দায়বদ্ধতা এবং দায়বদ্ধতার জন্য দায়বদ্ধ বা দায়ী নই। আমরা আপনার এবং পণ্যের বিক্রেতা বা নির্মাতাদের মধ্যে কোনো বিরোধ বা মতানৈক্যের মধ্যস্থতা বা সমাধান করব না। আমরা গুণমান, উপযুক্ততা, নির্ভুলতা, নির্ভরযোগ্যতা, সম্পূর্ণতা, সময়োপযোগীতা, কর্মক্ষমতা, নিরাপত্তা, ব্যবসায়িকতা, একটি নির্দিষ্ট উদ্দেশ্যে ফিটনেস, বা তালিকাভুক্ত বা প্রদর্শিত বা লেনদেন করা পণ্যের বৈধতা বা বিষয়বস্তুর (পণ্য বা মূল্য নির্ধারণ সহ) নির্দিষ্ট তথ্য এবং/অধিকারকের নির্দিষ্ট তথ্যের ক্ষেত্রে কোন ওয়্যারেন্টি বা উপস্থাপনা (ব্যক্ত বা উহ্য) স্পষ্টভাবে অস্বীকার করি। যদিও আমরা বিষয়বস্তুতে ভুল এড়াতে সতর্কতা অবলম্বন করেছি, এই সাইটটি, সমস্ত বিষয়বস্তু, তথ্য (পণ্যের মূল্য সহ), সফ্টওয়্যার, পণ্য, পরিষেবা এবং সম্পর্কিত গ্রাফিক্স কোন প্রকারের ওয়ারেন্টি ছাড়াই ভিত্তি হিসাবে প্রদান করা হয়েছে। আমরা সাইটে কোন পণ্য বিক্রয় বা ক্রয়কে অন্তর্নিহিত বা স্পষ্টভাবে সমর্থন করি না বা সমর্থন করি না। আমাদের সাথে সাইটের ভেস্টের মাধ্যমে বিক্রি করা বা প্রদর্শিত পণ্যগুলিতে কোনও অধিকার, শিরোনাম বা আগ্রহ থাকবে না বা সাইটের কোনও লেনদেনের ক্ষেত্রে এপকম ই-শপর কোনও বাধ্যবাধকতা বা দায় থাকবে না। আমাদের সাইটে তালিকাভুক্ত অন্য কোনো পরিষেবা প্রদানকারীর কোনো ক্রিয়া বা নিষ্ক্রিয়তার জন্য আমরা দায়বদ্ধ বা দায়ী থাকব না যার মধ্যে পেমেন্ট প্রদানকারী, কিস্তি অফার এবং অন্যদের মধ্যে ওয়ারেন্টি পরিষেবা অন্তর্ভুক্ত রয়েছে কিন্তু সীমাবদ্ধ নয়।

(ট) ক্ষতিপূরণ: এপকম ই-শপ বাংলাদেশের মালিকানাধীন ক্ষতিহীন এপকম ই-শপকে ক্ষতিপূরণ এবং ধরে রাখতে হবে যেটি বাংলাদেশ সরকারের আইন দ্বারা স্থানীয় সরকারের নিবন্ধকের (সিটি কর্পোরেশন) অধীনে বাংলাদেশে নিবন্ধিত একটি একমাত্র মালিকানা সংস্থা, এর অধীনস্থ সংস্থা, সহযোগী সংস্থা এবং তাদের সংশ্লিষ্ট কর্মকর্তা, পরিচালক, এজেন্ট এবং কর্মচারীদের যে কোনো দাবি বা দাবি, বা তৃতীয় পক্ষের দ্বারা যুক্তিসঙ্গত কোনো দাবী বা ক্রিয়াকলাপ বা দায়বদ্ধতা সহ দায়বদ্ধ পক্ষের দ্বারা করা হয়েছে। আপনার এই নিয়ম ও শর্তাবলীর লঙ্ঘন বা রেফারেন্স দ্বারা সংযোজিত কোনো নথি, অথবা কোনো আইন, বিধি, প্রবিধান বা তৃতীয় পক্ষের অধিকার আপনার লঙ্ঘন। আপনি এতদ্বারা এপকম ই-শপ বাংলাদেশের মালিকানাধীন একক মালিকানাধীন কোম্পানি এবং/অথবা এর সহযোগী এবং/অথবা তার কর্মকর্তা এবং প্রতিনিধিদের যেকোন খরচ, ক্ষতি, দায় বা বিক্রেতা বা অন্যান্য পরিষেবা প্রদানকারীর যেকোন ক্রিয়া/নিষ্ক্রিয়তার অন্য কোন পরিণতি থেকে এপকম ই-শপকে প্রকাশ করছেন এবং বিশেষভাবে কোন দাবি বা দাবি পরিত্যাগ করছেন যা এই আইনের অধীনে বা অন্য কোন চুক্তির অধীনে আপনার হতে পারে।

(ঠ) তৃতীয় পক্ষের ব্যবসা: এপকম ই-শপ এবং এর সহযোগী সংস্থাগুলি ছাড়া অন্য দলগুলি স্টোর পরিচালনা করতে পারে, পরিষেবা সরবরাহ করতে পারে বা সাইটে পণ্য লাইন বিক্রি করতে পারে। উদাহরণস্বরূপ, ব্যবসা এবং ব্যক্তিরা মার্কেটপ্লেসের মাধ্যমে পণ্য অফার করে। উপরন্তু, আমরা অনুমোদিত কোম্পানি এবং কিছু অন্যান্য ব্যবসার ওয়েবসাইটের লিঙ্ক প্রদান করি। আমরা পরীক্ষা বা মূল্যায়নের জন্য দায়ী নই, এবং আমরা এই ব্যবসা বা ব্যক্তিদের, বা তাদের ওয়েবসাইটের বিষয়বস্তুর কোনো প্রস্তাব বা অনুমোদন বা অনুমোদন করি না। আমরা এই এবং অন্য কোন তৃতীয় পক্ষের ক্রিয়া, পণ্য এবং বিষয়বস্তুর জন্য কোন দায়িত্ব বা দায়বদ্ধতা গ্রহণ করি না। আপনার লেনদেন সাবধানতার সাথে পর্যালোচনা করে আপনি যখন একটি তৃতীয় পক্ষ আপনার লেনদেনের সাথে জড়িত তা বলতে পারেন এবং আমরা সেই তৃতীয় পক্ষের সাথে সেই লেনদেনের সাথে সম্পর্কিত গ্রাহকের তথ্য শেয়ার করতে পারি। আপনি সাবধানে তাদের গোপনীয়তা বিবৃতি এবং সম্পর্কিত শর্তাবলী পর্যালোচনা করা উচিত.

(ড) আমাদের সাথে যোগাযোগ করা: আপনি যখন সাইটটি পরিদর্শন করেন, বা আমাদের কাছে ই-মেইল পাঠান, আপনি আমাদের সাথে বৈদ্যুতিনভাবে যোগাযোগ করছেন। আমাদের সাথে অর্ডার দেওয়ার সময় আপনাকে একটি বৈধ ফোন নম্বর প্রদান করতে হবে। আমরা আপনার সাথে ই-মেইল, এসএমএস, ফোন কল বা সাইটে নোটিশ পোস্ট করার মাধ্যমে বা অন্য যেকোন যোগাযোগের মাধ্যমে যোগাযোগ করতে পারি যা আমরা নিয়োগ করতে বেছে নিই। চুক্তিভিত্তিক উদ্দেশ্যে, আপনি আমাদের কাছ থেকে যোগাযোগ (লেনদেনমূলক, প্রচারমূলক এবং/অথবা বাণিজ্যিক বার্তা সহ) পেতে সম্মত হন, আপনার ওয়েবসাইট ব্যবহার করার বিষয়ে (এবং/অথবা আপনার অর্ডারের স্থান) এবং একই গুরুত্বের সাথে যোগাযোগের সমস্ত মোড ব্যবহার করতে সম্মত হন।

(ঢ) ক্ষতি: আমরা কোনো ব্যবসায়িক বা ব্যক্তিগত ক্ষতির জন্য দায়ী থাকব না (যার মধ্যে লাভ, রাজস্ব, চুক্তি, প্রত্যাশিত সঞ্চয়, ডেটা, সদিচ্ছা, বা নষ্ট খরচের ক্ষতি সহ কিন্তু সীমাবদ্ধ নয়) বা অন্য কোনো পরোক্ষ বা ফলস্বরূপ ক্ষতি যা আপনি এবং আমাদের উভয়ের জন্য যুক্তিসঙ্গতভাবে পূর্বাভাসযোগ্য নয় যখন আপনি সাইটটি ব্যবহার শুরু করেন।

(ণ) পরিষেবার শর্ত বা পরিবর্তন এবং সম্পর্কিত প্রতিশ্রুতিতে সংশোধনী: আমরা সাইট, এর নীতি, এই শর্তাবলী এবং অন্য যেকোন সর্বজনীনভাবে প্রদর্শিত শর্ত বা পরিষেবার প্রতিশ্রুতিতে যেকোনো সময় পরিবর্তন করার অধিকার সংরক্ষণ করি। আপনি সাইটটি ব্যবহার করার সময় কার্যকর নীতি এবং শর্তাবলীর সাপেক্ষে থাকবেন যদি না সেই নীতিগুলির কোনও পরিবর্তন বা এই শর্তগুলি আইন বা সরকারী কর্তৃপক্ষের দ্বারা করা প্রয়োজন হয় (যে ক্ষেত্রে এটি আপনার দ্বারা পূর্বে দেওয়া আদেশগুলিতে প্রযোজ্য হবে)। যদি এই শর্তগুলির মধ্যে যেকোনও অবৈধ, অকার্যকর, বা কোন কারণে অপ্রয়োগযোগ্য বলে গণ্য করা হয়, তবে সেই শর্তটি বিচ্ছেদযোগ্য বলে বিবেচিত হবে এবং বাকি কোনও শর্তের বৈধতা এবং প্রয়োগযোগ্যতাকে প্রভাবিত করবে না।

(ত) ঘটনাগুলি আমাদের নিয়ন্ত্রণের বাইরে: এই শর্তগুলির অধীনে আমাদের বাধ্যবাধকতাগুলি মেনে চলতে কোনও বিলম্ব বা ব্যর্থতার জন্য আমরা দায়ী হব না যদি বিলম্ব বা ব্যর্থতা আমাদের যুক্তিসঙ্গত নিয়ন্ত্রণের বাইরে এমন কোনও কারণে ঘটে। এই অবস্থা তোমার সংবিধিবদ্ধ অধিকারকে প্রভাবিত করবে না.

(থ) অধিকার পরিত্যাগের ঘোষণা: আপনি স্বীকার করেন এবং স্বীকার করেন যে আমরা একটি ব্যক্তিগত বাণিজ্যিক উদ্যোগ এবং আমরা উপযুক্ত মনে করি এমন পদ্ধতিতে আমাদের উদ্দেশ্যগুলি অর্জনের জন্য ব্যবসা পরিচালনা করার অধিকার সংরক্ষণ করি। আপনি আরও স্বীকার করেন যে আপনি যদি আমাদের সাইটে বর্ণিত শর্তগুলি লঙ্ঘন করেন এবং আমরা কোনও পদক্ষেপ না করি, আমরা এখনও আমাদের অধিকার এবং প্রতিকারগুলি অন্য যে কোনও পরিস্থিতিতে ব্যবহার করার অধিকারী যেখানে আপনি এই শর্তগুলি লঙ্ঘন করেন।

(দ) সমাপ্তি: সমাপ্তির তারিখের পূর্বে সংঘটিত পক্ষগুলির বাধ্যবাধকতা এবং দায়গুলি সমস্ত উদ্দেশ্যে এই চুক্তির সমাপ্তির পরে বেঁচে থাকবে৷ এই পরিষেবার শর্তাবলী কার্যকর হয় যদি না এবং যতক্ষণ না আপনি বা আমাদের দ্বারা সমাপ্ত হয়। আপনি যেকোন সময় আমাদের এই পরিষেবার শর্তাদি বন্ধ করে দিতে পারেন যে আপনি আমাদের পরিষেবাগুলি আর ব্যবহার করতে চান না, অথবা আপনি যখন আমাদের সাইট ব্যবহার বন্ধ করবেন। অন্য কোনো আইনি বা ন্যায়সঙ্গত প্রতিকার ছাড়াও, আমরা আপনাকে পূর্বে বিজ্ঞপ্তি ছাড়াই, শর্তাবলী ও শর্তাবলী অবিলম্বে বাতিল করতে পারি বা শর্তাবলীর অধীনে প্রদত্ত আপনার যেকোনো বা সমস্ত অধিকার প্রত্যাহার করতে পারি। এই চুক্তির যেকোন সমাপ্তির পরে, আপনি অবিলম্বে সাইটের সমস্ত অ্যাক্সেস এবং ব্যবহার বন্ধ করে দেবেন এবং আমরা, অন্য কোনও আইনি বা ন্যায়সঙ্গত প্রতিকার ছাড়াও, আপনাকে জারি করা সমস্ত পাসওয়ার্ড (গুলি) এবং অ্যাকাউন্ট সনাক্তকরণ অবিলম্বে প্রত্যাহার করব এবং সম্পূর্ণ বা আংশিকভাবে এই সাইটের আপনার অ্যাক্সেস এবং ব্যবহার অস্বীকার করব। এই চুক্তির যেকোন সমাপ্তি সমাপ্তির তারিখের আগে উদ্ভূত পক্ষগুলির সংশ্লিষ্ট অধিকার এবং বাধ্যবাধকতাগুলিকে (সীমাবদ্ধতা ছাড়াই, অর্থ প্রদানের বাধ্যবাধকতা সহ) প্রভাবিত করবে না। আপনি আরও সম্মত হন যে এই ধরনের কোনো স্থগিতাদেশ বা সমাপ্তির ফলে সাইটটি আপনার বা অন্য কোনো ব্যক্তির কাছে দায়বদ্ধ থাকবে না। আপনি যদি সাইটটির সাথে অসন্তুষ্ট হন বা সাইটটি পরিচালনার ক্ষেত্রে কোনো শর্ত, শর্ত, নিয়ম, নীতি, নির্দেশিকা বা অনুশীলনের সাথে অসন্তুষ্ট হন তবে আপনার একমাত্র এবং একচেটিয়া প্রতিকার হল সাইটটি ব্যবহার বন্ধ করা। যদি আমাদের একমাত্র বিচারে আপনি ব্যর্থ হন, বা আমাদের সন্দেহ হয় যে আপনি এই পরিষেবার শর্তাবলীর কোনো শর্ত বা বিধান মেনে চলতে ব্যর্থ হয়েছেন, আমরাও কোনো নোটিশ ছাড়াই এই চুক্তিটি বাতিল করতে পারি এবং আপনি সমাপ্তির তারিখ পর্যন্ত এবং সহ সমস্ত বকেয়া পরিমাণের জন্য দায়বদ্ধ থাকবেন; এবং/অথবা সেই অনুযায়ী আপনাকে আমাদের পরিষেবাগুলিতে অ্যাক্সেস অস্বীকার করতে পারে (বা এর কোনও অংশ)।

(ধ) সম্পূর্ণ চুক্তি: এই পরিষেবার শর্তাবলীর কোনো অধিকার বা বিধান প্রয়োগ বা প্রয়োগ করতে আমাদের ব্যর্থতা এই ধরনের অধিকার বা বিধানের মওকুফ গঠন করবে না। এই পরিষেবার শর্তাবলী এবং এই সাইটে বা পরিষেবার বিষয়ে আমাদের দ্বারা পোস্ট করা যে কোনও নীতি বা অপারেটিং নিয়মগুলি আপনার এবং আমাদের মধ্যে সম্পূর্ণ চুক্তি এবং বোঝাপড়া গঠন করে এবং আপনার এবং আমাদের মধ্যে যে কোনও পূর্বের বা সমসাময়িক চুক্তি, যোগাযোগ এবং প্রস্তাবগুলি, মৌখিক বা লিখিত যাই হোক না কেন, এই পরিষেবার ব্যবহারকে নিয়ন্ত্রণ করে (যেকোনো পরিষেবার শর্তাবলীর সংস্করণ সহ, তবে সীমাবদ্ধ নয়)। এই পরিষেবার শর্তাবলীর ব্যাখ্যায় কোন অস্পষ্টতা খসড়া দলের বিরুদ্ধে বোঝানো হবে না।

(ন) গভর্নিং আইন এবং এখতিয়ার: এই শর্তাবলী গণপ্রজাতন্ত্রী বাংলাদেশের আইন অনুসারে পরিচালিত হয়। আপনি সম্মত হন যে ঢাকা, বাংলাদেশে অবস্থিত আদালত, ট্রাইব্যুনাল এবং/অথবা আধা-বিচারিক সংস্থাগুলির এই চুক্তির অধীনে বাংলাদেশের অভ্যন্তরে উদ্ভূত যে কোনও বিরোধের একচেটিয়া এখতিয়ার থাকবে৷

(প) আমাদের সাথে যোগাযোগ করুন: আপনি আমাদের এখানে পৌঁছাতে পারেন

(ফ) আমাদের সফ্টওয়্যার: আমাদের সফ্টওয়্যারটিতে এমন যেকোন সফ্টওয়্যার অন্তর্ভুক্ত রয়েছে (সফ্টওয়্যারটির আপডেট বা আপগ্রেড এবং যে কোনও সম্পর্কিত ডকুমেন্টেশন সহ) যা আমরা সাইটের (“সফ্টওয়্যার”) সাথে আপনার ব্যবহারের জন্য সময়ে সময়ে আপনাকে উপলব্ধ করি।আপনি সফ্টওয়্যারটি শুধুমাত্র এই উদ্দেশ্যে ব্যবহার করতে পারেন যে আপনাকে আমাদের পরিষেবাগুলি ব্যবহার করতে এবং উপভোগ করতে সক্ষম করার শর্তাবলী এবং সাইটে উপলব্ধ যে কোনও সম্পর্কিত প্রযোজ্য শর্তাবলী দ্বারা অনুমোদিত৷ আপনি সফ্টওয়্যারটির কোনো অংশ আপনার নিজস্ব প্রোগ্রামগুলিতে অন্তর্ভুক্ত করতে পারবেন না বা আপনার নিজের প্রোগ্রামগুলির সাথে এটির কোনো অংশ সংকলন করতে পারবেন না, অন্য পরিষেবার সাথে ব্যবহারের জন্য এটি স্থানান্তর করতে পারবেন না বা সফ্টওয়্যারটি বিক্রি, ভাড়া, ইজারা, ধার, ঋণ, বিতরণ বা উপ-লাইসেন্স দিতে পারবেন না বা অন্যথায় সম্পূর্ণ বা আংশিকভাবে সফ্টওয়্যারটির কোনো অধিকার বরাদ্দ করতে পারবেন না৷ আপনি কোনো বেআইনি উদ্দেশ্যে সফটওয়্যার ব্যবহার করতে পারবেন না। আমরা আপনাকে পরিষেবা প্রদান বন্ধ করতে পারি এবং আমরা যে কোনো সময় আপনার সফ্টওয়্যার ব্যবহার করার অধিকার বাতিল করতে পারি। সফ্টওয়্যার ব্যবহার করার আপনার অধিকারগুলি স্বয়ংক্রিয়ভাবে আমাদের কাছ থেকে বিজ্ঞপ্তি ছাড়াই শেষ হয়ে যাবে যদি আপনি এখানে বা সাইট জুড়ে তালিকাভুক্ত যেকোন শর্ত ও শর্তাবলী মেনে চলতে ব্যর্থ হন। সাইটের মধ্যে থাকা অতিরিক্ত তৃতীয় পক্ষের শর্তাবলী বা বিতরণ করা হয় যেগুলি সম্পর্কিত ডকুমেন্টেশনে বিশেষভাবে চিহ্নিত করা হয় তা প্রযোজ্য হতে পারে এবং এই শর্তাবলীর সাথে বিরোধের ক্ষেত্রে এই ধরনের সফ্টওয়্যার ব্যবহারকে পরিচালনা করবে। আমাদের যেকোনো পরিষেবায় ব্যবহৃত সমস্ত সফ্টওয়্যার আমাদের সম্পত্তি এবং/অথবা আমাদের সহযোগী বা এর সফ্টওয়্যার সরবরাহকারী এবং বাংলাদেশের আইন দ্বারা সুরক্ষিত কিন্তু অন্যান্য প্রযোজ্য কপিরাইট আইনের মধ্যে সীমাবদ্ধ নয়। আপনি যখন সাইটটি ব্যবহার করেন, তখন আপনি এক বা একাধিক তৃতীয় পক্ষের পরিষেবাগুলিও ব্যবহার করতে পারেন, যেমন একটি বেতার ক্যারিয়ার বা একটি মোবাইল প্ল্যাটফর্ম প্রদানকারী৷ এই তৃতীয় পক্ষের পরিষেবাগুলির আপনার ব্যবহার এই তৃতীয় পক্ষের পৃথক নীতি, ব্যবহারের শর্তাবলী এবং ফি এর সাপেক্ষে হতে পারে। আপনি নাও পারেন, এবং আপনি অন্য কোনো ব্যক্তিকে অনুলিপি, পরিবর্তন, বিপরীত প্রকৌশলী, ডিকম্পাইল বা বিচ্ছিন্ন করতে বা অন্যথায় আমাদের সফ্টওয়্যার সম্পূর্ণ বা আংশিকভাবে, বা সফ্টওয়্যার থেকে বা এর থেকে কোনো ডেরিভেটিভ কাজ তৈরি করতে উত্সাহিত, সহায়তা বা অনুমোদন করবেন না। সফ্টওয়্যারটিকে আপ-টু-ডেট রাখার জন্য, আমরা যেকোন সময় এবং আপনাকে নোটিশ ছাড়াই স্বয়ংক্রিয় বা ম্যানুয়াল আপডেট অফার করতে পারি।

(৬) বিক্রয়ের শর্তাবলী (বিক্রেতা এবং গ্রাহকদের মধ্যে):

সাইটে বিক্রেতাদের (“আমরা” বা “আমাদের” বা “আমাদের”, যেখানেই প্রযোজ্য) কোনও পণ্যের জন্য অর্ডার দেওয়ার আগে দয়া করে এই শর্তগুলি সাবধানে পড়ুন। এই শর্তগুলি এই শর্তগুলির দ্বারা আবদ্ধ হওয়ার জন্য আপনার চুক্তিকে নির্দেশ করে৷

(ক) পণ্য বা পরিষেবা বিক্রয় সম্পর্কিত শর্তাবলী এই বিভাগটি সাইটে পণ্য বা পরিষেবার বিক্রয় সংক্রান্ত শর্তাবলী নিয়ে কাজ করে।.

(খ) চুক্তি: আপনার অর্ডারটি আমাদের সাইটে প্রদর্শিত পণ্য বা পরিষেবা কেনার জন্য বিক্রেতার কাছে একটি আইনি অফার। আপনি যখন একটি পণ্য কেনার জন্য একটি অর্ডার দেন, তখন আপনার অর্ডার পাঠানোর আগে প্রাপ্ত যেকোন নিশ্চিতকরণ বা স্ট্যাটাস আপডেটগুলি সম্পূর্ণরূপে প্রদত্ত অর্ডারের বিশদটি যাচাই করার জন্য কাজ করে এবং কোনওভাবেই অর্ডারের নিশ্চিতকরণ বোঝায় না। যখন পণ্যটি আপনার কাছে পাঠানো হয় তখন আপনার অর্ডারের গ্রহণযোগ্যতা নিশ্চিত করা হয়। আপনার অর্ডার একাধিক প্যাকেজে পাঠানো হলে, আপনি পৃথক প্রেরণ নিশ্চিতকরণ পেতে পারেন। অর্ডার দেওয়ার সময়, আমরা একটি আনুমানিক টাইমলাইন নির্দেশ করি যে আপনার অর্ডারের প্রক্রিয়াকরণে সময় লাগবে তবে আমরা এই প্রতিশ্রুতি রক্ষা করার জন্য তৃতীয় পক্ষের পরিষেবা প্রদানকারীদের উপর নির্ভরশীল হওয়ায় প্রতিটি ক্ষেত্রে এই টাইমলাইনটি কঠোরভাবে সুনির্দিষ্ট হওয়ার গ্যারান্টি দিতে পারি না। নির্দেশক টাইমলাইন পূরণ হয়েছে তা নিশ্চিত করার জন্য আমরা আপনার কাছে প্রতিশ্রুতিবদ্ধ। সমস্ত বাণিজ্যিক/চুক্তিমূলক শর্তাবলী আপনার এবং বিক্রেতাদের মধ্যে একাই অফার করে এবং সম্মত হয়। বাণিজ্যিক/চুক্তিমূলক শর্তাবলীর মধ্যে রয়েছে সীমাহীন মূল্য, শিপিং খরচ, অর্থপ্রদানের পদ্ধতি, অর্থপ্রদানের শর্তাবলী, তারিখ, সময়কাল এবং ডেলিভারির মোড, পণ্য ও পরিষেবার সাথে সম্পর্কিত ওয়্যারেন্টি এবং পণ্য ও পরিষেবার সাথে সম্পর্কিত বিক্রয়োত্তর পরিষেবা। এপকম ই-শপর কোনো নিয়ন্ত্রণ নেই বা আপনার এবং বিক্রেতাদের মধ্যে এই ধরনের বাণিজ্যিক/চুক্তিমূলক শর্তাবলীর প্রস্তাব বা গ্রহণযোগ্যতা নির্ধারণ বা পরামর্শ দেয় না বা কোনোভাবেই নিজেকে জড়িত করে না। বিক্রেতা প্রেরণের আগে তার নিজস্ব বিবেচনার ভিত্তিতে যেকোনো অর্ডার বাতিল করার অধিকার রাখে। আমরা নিশ্চিত করব যে আপনাকে একটি ইমেল বা এসএমএসের মাধ্যমে এই জাতীয় বাতিলকরণের সময়মত অবহিত করা হয়েছে। এই ধরনের বাতিলকরণ(গুলি) ক্ষেত্রে করা যেকোনো প্রিপেমেন্ট এখানে নির্ধারিত সময়ের মধ্যে আপনাকে ফেরত দেওয়া হবে।

(গ) এক্সচেঞ্জ/রিটার্ন : এখানে আমাদের রিটার্ন নীতি পর্যালোচনা করুন।

(ঘ) মূল্য নির্ধারণ, প্রাপ্যতা এবং অর্ডার প্রক্রিয়াকরণ : সমস্ত মূল্য বাংলাদেশী টাকায় (বিডিটি) তালিকাভুক্ত করা হয়েছে এবং ভ্যাট সহ এবং পণ্য বা পরিষেবা বিক্রিকারী বিক্রেতার দ্বারা সাইটে তালিকাভুক্ত করা হয়েছে। আপনার শপিং কার্টের আইটেমগুলি সর্বদা আইটেমের পণ্যের বিশদ পৃষ্ঠায় প্রদর্শিত সাম্প্রতিকতম মূল্য প্রতিফলিত করবে। অনুগ্রহ করে মনে রাখবেন যে এই মূল্যটি আইটেমটির জন্য দেখানো মূল্য থেকে ভিন্ন হতে পারে যখন আপনি এটিকে আপনার কার্টে প্রথম রেখেছিলেন৷ আপনার কার্টে একটি আইটেম রাখা সেই সময়ে দেখানো মূল্য সংরক্ষণ করে না। এটাও সম্ভব যে একটি আইটেমের দাম আপনি আপনার ঝুড়িতে রাখার সময় এবং আপনি এটি কেনার সময়ের মধ্যে হ্রাস পেতে পারে। আমরা আমাদের সাইট বা অন্যান্য ওয়েবসাইটে কোনো বিক্রেতার দ্বারা বিক্রি করা কোনো আইটেমের জন্য দামের মিল অফার করি না। আমরা আমাদের ব্যবহারকারীদের সাইটে সবচেয়ে সঠিক মূল্যের তথ্য প্রদান করতে বদ্ধপরিকর; যাইহোক, ত্রুটিগুলি এখনও ঘটতে পারে, যেমন ক্ষেত্রে যখন কোনও আইটেমের মূল্য সাইটে সঠিকভাবে প্রদর্শিত হয় না। যেমন, আমরা কোনো আদেশ প্রত্যাখ্যান বা বাতিল করার অধিকার সংরক্ষণ করি। কোনো আইটেমের মূল্য ভুল হলে, আমরা আমাদের নিজস্ব বিবেচনার ভিত্তিতে নির্দেশের জন্য আপনার সাথে যোগাযোগ করতে পারি বা আপনার অর্ডার বাতিল করতে পারি এবং এই ধরনের বাতিলকরণের বিষয়ে আপনাকে অবহিত করতে পারি। আদেশটি নিশ্চিত করা হয়েছে বা না হয়েছে এবং আপনার প্রিপেমেন্ট প্রক্রিয়া করা হয়েছে কিনা তা প্রত্যাখ্যান বা বাতিল করার অধিকার আমাদের থাকবে। আপনার প্রিপেইড অর্ডারে এই ধরনের বাতিলকরণ ঘটলে, আমাদের অর্থ ফেরতের নীতি প্রযোজ্য হবে। অনুগ্রহ করে নোট করুন যে এপকম ই-শপ ফেরত দেওয়ার পরিমাণের 100% অধিকার রাখে। সাধারনত যেকোন ধরণের ডিসকাউন্ট এবং শিপিং ফি কেটে নেওয়ার পরে গ্রাহকের প্রদত্ত মূল্যের উপর ভিত্তি করে ফেরতের পরিমাণ গণনা করা হয়। আমরা প্রতিটি পণ্য তথ্য পৃষ্ঠা সহ সাইটে তালিকাভুক্ত পণ্যগুলির জন্য উপলব্ধতার তথ্য তালিকাভুক্ত করি। আমরা সেই পৃষ্ঠায় বা অন্যথায় সাইটে যা বলি তার বাইরে, আমরা প্রাপ্যতা সম্পর্কে আরও নির্দিষ্ট হতে পারি না। অনুগ্রহ করে মনে রাখবেন যে প্রেরণের অনুমানগুলি ঠিক তা। এগুলি প্রেরণের সময় গ্যারান্টিযুক্ত নয় এবং এর উপর নির্ভর করা উচিত নয়। আমরা আপনার অর্ডার প্রক্রিয়া করার সাথে সাথে আপনার অর্ডার করা কোনো পণ্য অনুপলব্ধ হলে আপনাকে ই-মেইল বা এসএমএসের মাধ্যমে জানানো হবে। অনুগ্রহ করে মনে রাখবেন যে এমন কিছু ক্ষেত্রে রয়েছে যখন বিভিন্ন কারণে একটি আদেশ প্রক্রিয়া করা যায় না। সাইটটি যে কোনো সময় যেকোনো কারণে যেকোনো আদেশ প্রত্যাখ্যান বা বাতিল করার অধিকার সংরক্ষণ করে। আমরা অর্ডার গ্রহণ করার আগে আপনাকে ফোন নম্বর এবং ঠিকানা সহ কিন্তু সীমাবদ্ধ নয় অতিরিক্ত যাচাই বা তথ্য প্রদান করতে বলা হতে পারে। ক্রেডিট বা ডেবিট কার্ডের সাথে কোনো প্রতারণা এড়াতে, আপনাকে পণ্য সরবরাহ করার আগে এবং আপনি আমাদের সাথে যে ব্যক্তিগত তথ্য ভাগ করেছেন তা যাচাই করার আগে আমরা আপনার অর্থপ্রদানের বিবরণের বৈধতা পাওয়ার অধিকার সংরক্ষণ করি। এই যাচাইকরণটি একটি পরিচয়, বসবাসের স্থান বা ব্যাঙ্কিং তথ্য চেকের আকার নিতে পারে। এই ধরনের একটি তদন্তের পরে একটি উত্তরের অনুপস্থিতি স্বয়ংক্রিয়ভাবে একটি যুক্তিসঙ্গত সময়রেখার মধ্যে অর্ডার বাতিলের কারণ হবে৷ আমরা একটি অর্ডার সরাসরি বাতিল করার জন্য এগিয়ে যাওয়ার অধিকার সংরক্ষণ করি যার জন্য আমরা পূর্ব নোটিশ বা পরবর্তী কোনো আইনি দায় ছাড়াই ব্যাঙ্কিং যন্ত্রের প্রতারণামূলক ব্যবহারের ঝুঁকি বা অন্যান্য কারণে সন্দেহ করি।

রিফান্ড ভাউচার

(১) প্রদত্ত টাইমলাইনের মধ্যে আমাদের ওয়েবসাইট থেকে পণ্যের সম্পূর্ণ বা আংশিক অর্থপ্রদান হিসাবে রিফান্ড ভাউচারটি আমাদের ওয়েবসাইটে রিডিম করা যেতে পারে।
(২) রিফান্ড ভাউচার ভিন্ন অ্যাকাউন্ট থেকে ব্যবহার করা যাবে না।
(৩) মেয়াদ উত্তীর্ণ হলে ভাউচারগুলি পরিবর্তনযোগ্য নয়৷
(৪) রিফান্ড ভাউচার কোড শুধুমাত্র একবার প্রয়োগ করা যেতে পারে। রিফান্ড ভাউচারের অবশিষ্ট পরিমাণ একবার প্রয়োগ করার পরে, যদি থাকে, তা ফেরত দেওয়া হবে না এবং পরবর্তী কেনাকাটার জন্য ব্যবহার করা যাবে না এমনকি যদি অর্ডারের মূল্য অবশিষ্ট ভাউচার মূল্যের চেয়ে ছোট হয়। প্রচারমূলক ভাউচার প্রতিটি জারি করা প্রচারমূলক ভাউচার (অ্যাপ ভাউচার এবং নতুন গ্রাহক ভাউচার) একজন গ্রাহক শুধুমাত্র একবার ব্যবহার করার জন্য বৈধ হবে। একাধিক ব্যবহার পরিচয় পরিবর্তন করা অবৈধ।
(১) প্রচারমূলক ভাউচার এবং কার্ট রুল ডিসকাউন্ট উভয়ই একই সময়ে যোগ করা যাবে না।
(২) প্রচারমূলক ভাউচার ফেরতযোগ্য নয় এবং আংশিক বা সম্পূর্ণ নগদ বিনিময় করা যাবে না এবং শুধুমাত্র একটি একক লেনদেনের জন্য বৈধ।
(৩) প্রচারমূলক ভাউচার বিক্রির সময় বা কোনো বিশেষ প্রচারের সাথে বৈধ নাও হতে পারে।
(৪) ন্যূনতম ক্রয়ের পরিমাণ এবং অন্যান্য শর্ত পূরণ হলেই ভাউচার কাজ করবে।
(৫) এপকম ই-শপ কোনো নোটিশ ছাড়াই যেকোনো সময়ে যেকোনো ভাউচারের অপারেশন পরিবর্তন বা বন্ধ করার অধিকার সংরক্ষণ করে।
(৬) কোনো ভাউচার প্রত্যাখ্যান, বাতিল বা প্রত্যাহার বা কোনো কারণে কোনো গ্রাহকের ভাউচার ব্যবহারে ব্যর্থতা বা অক্ষমতার ফলে উদ্ভূত কোনো আর্থিক ক্ষতির জন্য এপকম ই-শপ কোনো গ্রাহক বা পরিবারের কাছে দায়বদ্ধ থাকবে না।
(৭) মেয়াদ উত্তীর্ণ হলে ভাউচারগুলি পরিবর্তনযোগ্য নয়৷

(ঙ) নিরাপত্তা:

জালিয়াতি আপনি যখন একটি ভাউচার ব্যবহার করেন, তখন আপনি এপকম ই-শপর কাছে ওয়ারেন্টি দেন যে আপনি ভাউচারটির যথাযথভাবে অনুমোদিত প্রাপক এবং আপনি এটি সরল বিশ্বাসে ব্যবহার করছেন। আপনি যদি ভাউচার রিডিম করেন, ভাউচার রিডিম করার চেষ্টা করেন বা ছাড় পাওয়ার জন্য উৎসাহিত করেন যার জন্য আপনি প্রাপ্য নন আপনি একটি দেওয়ানি বা ফৌজদারি অপরাধ করতে পারেন যদি আমরা যুক্তিসঙ্গতভাবে বিশ্বাস করি যে কোনো ভাউচার বেআইনি বা বেআইনিভাবে ব্যবহার করা হচ্ছে আমরা কোনো ভাউচার/অর্ডার প্রত্যাখ্যান বা বাতিল করতে পারি এবং আপনি সম্মত হন যে কোনো প্রত্যাখ্যান বা বাতিলের ক্ষেত্রে আমাদের বিরুদ্ধে আপনার কোনো দাবি থাকবে না। এপকম ই-শপ এই ধরনের পরিস্থিতিতে উপযুক্ত বলে মনে করে পরবর্তী পদক্ষেপ নেওয়ার অধিকার সংরক্ষণ করে

(চ) ট্যাক্স:

আপনি সাইট থেকে পণ্য ক্রয়ের সাথে সম্পর্কিত সমস্ত ফি/খরচ/চার্জ প্রদানের জন্য দায়ী থাকবেন এবং আপনি প্রচলিত আইন অনুযায়ী যে কোনো এবং সমস্ত প্রযোজ্য কর বহন করতে সম্মত হন।

(ছ) প্রতিনিধিত্ব এবং ওয়্যারেন্টি:

যখন পণ্য বা পরিষেবা তৃতীয় পক্ষের দ্বারা বিক্রি করা হয় তখন সাইটে বিক্রি করার জন্য তালিকাভুক্ত পণ্য বা পরিষেবাগুলির সুনির্দিষ্ট (যেমন গুণমান, মান, বিক্রয়যোগ্যতা, ইত্যাদি) সম্পর্কে আমরা কোনও প্রতিনিধিত্ব বা ওয়ারেন্টি করি না। আমরা সাইটটিতে কোনো পণ্য বা পরিষেবার বিক্রয় বা ক্রয়কে অন্তর্নিহিত বা স্পষ্টভাবে সমর্থন করি না বা সমর্থন করি না। নিজের বা তৃতীয় পক্ষের পক্ষ থেকে হোক না কেন আমরা কোনো ত্রুটি বা বাদ পড়ার জন্য কোনো দায় স্বীকার করি না। আমরা আপনার এবং বিক্রেতাদের মধ্যে প্রবেশ করা কোনো চুক্তির অ-কর্মক্ষমতা বা লঙ্ঘনের জন্য দায়ী নই। আমরা আপনার বা বিক্রেতাদের কাজের গ্যারান্টি দিতে পারি না এবং দিতে পারি না কারণ তারা সাইটে লেনদেন শেষ করে। আমাদের সাইটে ঘটছে লেনদেন থেকে উদ্ভূত কোনো বিরোধ বা মতবিরোধের মধ্যস্থতা বা সমাধান করার প্রয়োজন নেই। আমাদের সাইটে তৃতীয় পক্ষের সাথে আপনার দ্বারা প্রবেশ করা কোনও লেনদেনের সময় আমরা কোনও সময়েই শিরোনাম অর্জন করি না বা কোনও বিক্রেতার দ্বারা প্রদত্ত পণ্য বা পরিষেবাগুলির উপর কোনও অধিকার বা দাবি করি না। অতএব, আপনার এবং বিক্রেতার (গুলি) মধ্যে এই ধরনের চুক্তি(গুলি) সম্বন্ধে আমাদের কোনো বাধ্যবাধকতা বা দায়বদ্ধতা নেই৷ আমরা পরিষেবার অসন্তোষজনক বা বিলম্বিত কর্মক্ষমতা বা স্টক শেষ, অনুপলব্ধ বা ফিরে অর্ডার করা পণ্যগুলির ফলে ক্ষতি বা বিলম্বের জন্য দায়ী নই। সাইটে প্রতিফলিত কোনো পণ্য (গুলি) বা সম্পর্কিত তথ্যের মূল্য নির্ধারণ কিছু প্রযুক্তিগত সমস্যা, টাইপোগ্রাফিক ত্রুটি বা অন্য কারণে প্রকাশিত হিসাবে ভুল দ্বারা হতে পারে এবং ফলস্বরূপ আপনি স্বীকার করেন যে এই ধরনের পরিস্থিতিতে বিক্রেতা বা সাইট আপনার অর্ডার বাতিল করতে পারে কোনো পূর্ব বিজ্ঞপ্তি ছাড়াই বা এর ফলে উদ্ভূত কোনো দায়বদ্ধতা। এই ধরনের অর্ডারের জন্য করা যেকোনো প্রিপেমেন্ট আমাদের রিফান্ড নীতি অনুযায়ী আপনাকে ফেরত দেওয়া হবে।

(জ) অন্যান্য:

(১) স্টক প্রাপ্যতা: অর্ডারগুলি স্টকের প্রাপ্যতা সাপেক্ষে।
(২) ডেলিভারি টাইমলাইন: ডেলিভারি স্বাভাবিক সময়সীমা/লাইনের চেয়ে বেশি সময় নিতে পারে এপকম ই-শপ অনুসরণ করতে। ফোর্স ম্যাজেউর ইভেন্টের কারণে ডেলিভারি বিলম্বিত হতে পারে যার মধ্যে রাজনৈতিক অস্থিরতা, রাজনৈতিক ইভেন্ট, জাতীয়/সরকারি ছুটির দিন, ইত্যাদি অন্তর্ভুক্ত রয়েছে তবে এতে সীমাবদ্ধ নয়

(n) Governing Law and Jurisdiction: These Terms are governed by the laws of the People’s Republic of Bangladesh. You agree that the courts, tribunals and/or quasi-judicial bodies located in Dhaka, Bangladesh shall have exclusive jurisdiction over any dispute arising within Bangladesh under this Agreement.

(f) Our Software: Our Software includes any software (including updates or upgrades to the Software and any related documentation) that we make available to you from time to time for your use in connection with the Site (“Software”). You may use the Software solely for the purposes permitted by these Terms and Conditions and any applicable terms and conditions available on the Site. You may not incorporate any portion of the Software into your own programs or compile any portion of it with your own programs, transfer it for use with another Service, or sell, rent, lease, lend, loan, distribute or sublicense the Software or otherwise assign any rights to the Software, in whole or in part. You may not use the Software for any unlawful purpose. We may stop providing the Service to you and we may terminate your right to use the Software at any time. Your rights to use the Software will automatically terminate without notice from us if you fail to comply with any of the terms and conditions listed here or throughout the Site. Additional third party terms and conditions contained within the Site or distributed that are specifically identified in the related documentation may apply and will govern your use of such software to the extent of any conflict with these Terms. All software used in any of our Services is the property of us and/or our affiliates or its software suppliers and is protected by the laws of Bangladesh, including but not limited to other applicable copyright laws. When you use the Site, you may also use one or more third party services, such as a wireless carrier or a mobile platform provider. Your use of these third party services may be subject to the separate policies, terms of use and fees of such third parties. You may not, and you will not encourage, assist or authorize any other person to copy, modify, reverse engineer, decompile or disassemble or otherwise create any derivative works from or to our Software, in whole or in part, or from or from the Software. In order to keep the Software up-to-date, we may offer automatic or manual updates at any time and without notice to you.

(6) Terms of Sale (Between Sellers and Customers):
Please read these Terms carefully before placing an order for any product from Sellers (“we” or “us” or “our”, as applicable) on the Site. These Terms constitute your agreement to be bound by these Terms.

(a) Terms of Sale of Goods or Services This section deals with the terms and conditions of sale of goods or services on the Site.

(b) Agreement: Your order is a legal offer to the Seller to purchase the goods or services displayed on our Site. When you place an order to purchase a product, any confirmation or status updates received before your order is dispatched are solely to verify the details of the order provided and do not in any way constitute confirmation of the order. Acceptance of your order is confirmed when the product is dispatched to you. If your order is dispatched in multiple packages, you may receive separate dispatch confirmations.

When placing an order, we indicate an approximate timeline that your order will take to process but we cannot guarantee that this timeline will be strictly precise in every case as we are dependent on third party service providers to deliver on this promise. We are committed to you to ensure that the indicative timeline is met. All commercial/contractual terms are offered and agreed upon solely between you and the Sellers. The commercial/contractual terms include, without limitation, the price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties relating to the goods and services and after-sales service relating to the goods and services. Epcom E-Shop has no control over or does not determine or advise or involve itself in any way in the offer or acceptance of such commercial/contractual terms between you and the Sellers. The Seller reserves the right to cancel any order at its sole discretion prior to dispatch. We will ensure that you are notified of such cancellation in a timely manner via an email or SMS. Any prepayments made in the event of such cancellation(s) will be refunded to you within the time period set out herein.

(d) Pricing, Availability and Order Processing: All prices are listed in Bangladeshi Taka (BDT) and are inclusive of VAT and are as listed on the Site by the Seller selling the product or service. The items in your shopping cart will always reflect the most recent price displayed on the item’s product detail page. Please note that this price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart does not preserve the price shown at that time. It is also possible that the price of an item may decrease between the time you place it in your basket and the time you purchase it. We do not offer price matching for any items sold by any seller on our Site or other websites. We are committed to providing our users with the most accurate pricing information on the Site; however, errors may still occur, such as in cases where the price of an item is not displayed correctly on the Site. As such, we reserve the right to refuse or cancel any order. If an item is priced incorrectly, we may, at our sole discretion, contact you for instructions or cancel your order and notify you of such cancellation. We reserve the right to refuse or cancel the order whether or not it has been confirmed and your prepayment has been processed. In the event of such cancellation of your prepaid order, our refund policy will apply. Please note that Epcom E-Shop reserves the right to 100% of the refund amount. Refund amounts are generally calculated based on the price paid by the customer after deducting any discounts and shipping fees. We list the refund amount on the Site with each product information page.

We list availability information for products. Beyond what we say on that page or otherwise on the Site, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon. You will be notified by email or SMS as soon as we process your order if any product you have ordered is unavailable. Please note that there are instances when an order cannot be processed for various reasons. The Site reserves the right to refuse or cancel any order at any time for any reason. You may be asked to provide additional verification or information, including but not limited to phone number and address, before we accept your order. To avoid any fraud with credit or debit cards, we reserve the right to obtain the validity of your payment details before delivering the product to you and to verify the personal information you have shared with us. This verification may take the form of an identity, place of residence or banking information check. Failure to respond to such an inquiry within a reasonable timeframe will automatically result in the cancellation of the order. We reserve the right to proceed to cancel an order outright for which we suspect the risk of fraudulent use of banking instruments or for other reasons without prior notice or any further legal liability.

Refund Voucher
(1) The refund voucher can be redeemed on our website as full or partial payment for the product from our website within the given timeline.
(2) The refund voucher cannot be used from a different account.
(3) Vouchers are not transferable once expired.
(4) The refund voucher code can be applied only once. The remaining amount of the refund voucher after applying it once, if any, will not be refunded and cannot be used for subsequent purchases even if the order value is less than the remaining voucher value. Promotional Vouchers Each issued promotional voucher (App Voucher and New Customer Voucher) will be valid for one customer to use only once. Multiple use identity changes are illegal.
(1) Both promotional vouchers and cart rule discounts cannot be added at the same time.
(2) Promotional vouchers are non-refundable and cannot be exchanged for cash in part or in full and are valid for a single transaction only.
(3) Promotional vouchers may not be valid during sales or with any special promotions.
(4) Vouchers will only be valid if the minimum purchase amount and other conditions are met.
(5) Epcom E-Shop reserves the right to change or discontinue the operation of any voucher at any time without notice.
(6) Epcom E-Shop shall not be liable to any customer or household for any financial loss arising from the rejection, cancellation or withdrawal of any voucher or the failure or inability of any customer to use the voucher for any reason.
(7) Vouchers are not exchangeable once expired.
(e) Security:
Fraud When you use a voucher, you warrant to Epcom E-Shop that you are the duly authorized recipient of the voucher and that you are using it in good faith. You may be committing a civil or criminal offence if you redeem a voucher, attempt to redeem a voucher or induce someone to obtain a discount for which you are not entitled. We may reject or cancel any voucher/order if we reasonably believe that any voucher is being used illegally or unlawfully and you agree that you will have no claim against us in the event of any rejection or cancellation. Epcom E-Shop reserves the right to take such further action as it deems appropriate in such circumstances.

(f) Taxes:
You shall be responsible for paying all fees/costs/charges associated with the purchase of products from the Site and you agree to bear any and all applicable taxes in accordance with prevailing law.

(g) Representations and Warranties:
We make no representations or warranties about the specifics (such as quality, value, merchantability, etc.) of the products or services listed for sale on the Site when they are sold by third parties. We do not endorse or support, implicitly or explicitly, the sale or purchase of any products or services on the Site. We assume no liability for any errors or omissions, whether on our own or on the part of third parties. We are not responsible for the non-performance or breach of any agreement entered into between you and sellers. We cannot and do not guarantee the performance of your or sellers’ work because they complete transactions on the Site. We are not required to mediate or resolve any disputes or disagreements arising from transactions occurring on the Site. We do not acquire title to or have any right or claim to the products or services offered by any seller at any time during any transaction entered into by you with a third party on our Site. Accordingly, we have no obligation or liability with respect to such agreement(s) between you and the seller(s). We are not responsible for any loss or delay resulting from unsatisfactory or delayed performance of the Service or from products being out of stock, unavailable or back ordered. The pricing of any product(s) or related information reflected on the Site may be incorrect as published due to technical issues, typographical errors or other reasons and consequently you acknowledge that in such circumstances the Seller or the Site may cancel your order without any prior notice or any liability arising therefrom. Any prepayment made for such orders will be refunded to you in accordance with our refund policy.

(1) Stock Availability: Orders are subject to stock availability.

(2) Delivery Timeline: Delivery may take longer than the normal timeframe/line to follow Epcom E-Shop. Delivery may be delayed due to force majeure events which include but are not limited to political unrest, political events, national/government holidays, etc.

(3) Cancellation: Epcom E-Shop reserves the unqualified right to cancel any order at its sole discretion and for any reason including but not limited to the product being priced incorrectly, out of stock, expired, defective, faulty, and having incorrect information or description arising out of technical or typographical errors.

(4) Exchange / Refund Timeline: If an order is to be exchanged or cancelled, the payment or exchange against such order will be exchanged or refunded within 10 to 15 working days, however in exceptional cases it may take longer. Provided that the cashback amount received, if any, will be adjusted against the refund amount. You confirm that the product(s) or service(s) ordered by you have been purchased for your internal/personal use and not for commercial resale. You authorize us to provide declarations and statements on your behalf to any government authority stating the aforementioned purpose for your order on the Site. The Seller or the Site may cancel an order where the quantities exceed ordinary personal consumption. This applies both to the number of products ordered within a single order and to the placing of several orders for the same product where individual orders consist of a quantity that exceeds ordinary personal consumption. The limits of what constitutes an ordinary person’s consumption will be based on a variety of factors and will be at the sole discretion of the Seller or us and may vary from person to person.
